Do NOT falsify his job title. Putting "IT Executive" or "Graphic Designer" on the EP when his actual work is operations is document fraud. Legal Basis

EP Category III salary minimum is set by the Expatriate Services Division (ESD) under the Ministry of Home Affairs. From 1 June 2026, the revised threshold is RM 5,000/month basic. Allowances (transport, housing, mobile) do NOT count toward this figure — only basic monthly salary as stated in the employment contract.

How to document the salary correctly

  • Update the employment contract or issue a written addendum
  • Reflect the new salary in at least 1 month's payslip before EP submission — ESD will ask for this
  • Update SOCSO contribution to reflect new salary amount

Suggested salary for this role

RM 5,000–6,500/month is market-appropriate for an Operations Executive in a KL service apartment. Pitching RM 5,500–6,000 is safer than the absolute minimum — it shows the role is genuinely valued.

If he is currently paid significantly below RM 5,000, ESD may question a sudden large jump. Back it up with a promotion letter clearly stating expanded responsibilities and an org chart showing his seniority level. See Template 3.

Recommended Job Title

Operations Executive — or alternatively Property Operations Executive. Both are honest, professional, and qualify for EP Category III in the services sector.

Why his IT & design skills help (without changing his title)

In the job description, include responsibilities that use his IT and design knowledge naturally within operations. For example:

  • Oversee day-to-day operations of [X] service apartment units
  • Manage property management system (PMS) — data entry, reporting, troubleshooting
  • Coordinate with tech vendors for smart lock systems, CCTV, WiFi infrastructure
  • Produce digital marketing materials, room photography, and listing updates on Airbnb/Agoda/Booking.com

ESD mandates that employers demonstrate a genuine effort to hire a Malaysian before approving a foreign national for an EP. This is reviewed — not rubber-stamped. A missing or weak job ad is one of the top reasons ESD rejects post applications.

The combined requirement naturally limits the local applicant pool and strengthens your case.

The ESD portal (ePASS / MYXpats Centre) at esd.imi.gov.my is the official Immigration Department platform for all Employment Pass applications. All submissions, approvals, renewals and notifications happen here — there is no paper process.

Step-by-step: create company account

  3. Fill in: company name, SSM registration number, business address, industry (select Services), contact person details

  5. Submit — you will receive an activation email within 3–7 working days

Before submitting the EP application for the Syrian worker, Maple Home must first get an "Expatriate Post" approved by ESD. This approves the job position — not the individual person yet. Only after the post is approved can you name the specific employee. Typical processing: 5–15 working days.

What is an Expatriate Post?

An ESD-approved quota slot for one foreign employee in a specific role. Maple Home must justify to ESD why this particular role cannot be filled by a Malaysian. The post is approved first; then you attach the specific candidate (the Syrian worker) to the approved post in Phase 4.

  • Organisational Chart — shows where "Operations Executive" sits in the company structure, who this person reports to, and who reports to them
  • Latest audited financial statements — last 1–2 years. Proves the company is financially able to pay the declared salary. Obtained from your company accountant or via SSM.

Scenario 1 — Valid Syrian Passport ✅

Best case. Upload the bio page as the primary identity document. Proceed normally.

Scenario 2 — Expired Syrian Passport ⚠️

Submit the expired passport anyway — ESD accepts it as identity evidence. Additionally provide:

  • Expired passport bio page (still required for identity)
  • Current UNHCR Refugee Card

Scenario 3 — No Passport At All ❌ (hardest case)

  • Request a UNHCR Attestation Letter specifically stating identity and refugee status — this serves as the primary identity document
  • Request a UNHCR Travel Document if available (issued under 1951 Refugee Convention principles, though Malaysia is not a signatory — UNHCR Malaysia may still issue this)
  • Submit a detailed cover letter from Maple Home to ESD explaining: (a) why no passport exists, (b) the worker's established 7-year presence in Malaysia, (c) employer undertaking full responsibility

ESD emails the employer via ePASS when the EP is approved. From that point you have a limited window to complete the remaining steps before the approval lapses. Do not delay.

Step 1 — Receive the Approval Notification

ESD sends an approval notification to the employer's ePASS account. Log in, download and print the EP Approval Letter. This letter is the worker's legal authority to work while the physical EP sticker is being processed — he must carry it at all times.

Step 2 — Pay the EP Issuance Fee

Pay the issuance fee online via ePASS (included in the RM 300–600 or a separate charge — the portal will indicate the exact amount). Payment is by credit/debit card or FPX.

Step 3 — Book Immigration Appointment for EP Sticker

The EP sticker (endorsement in travel document) is placed at the nearest Immigration Department (Jabatan Imigresen Malaysia) office. Book an appointment via:

EP sticker / endorsement processing time

Same-day or next working day at the immigration office. The worker is legally employed from the date on the Approval Letter — the sticker is the physical evidence.

Keep a certified copy of the EP Approval Letter at the Maple Home office. Under the Immigration Act, the employer must be able to produce employment documentation during any inspection.

Under ESD guidelines, all EP holders must have valid medical and hospitalisation insurance arranged by the employer. This is verified at each renewal.

Minimum coverage required

  • Medical and hospitalisation coverage
  • Minimum sum insured: RM 10,000–20,000 per year (confirm exact current figure at esd.imi.gov.my)
  • Policy must name the employee specifically by name and passport/UNHCR number
  • Policy must be valid for the full duration of the EP

Where to get quotes

Typical cost: RM 800–2,000/year. Get at least 3 quotes. Some insurers do not cover refugee-status employees — specify his status when requesting quotes and confirm acceptance before purchasing.

After the EP is issued, there are ongoing obligations Maple Home must maintain throughout the EP validity period.
  • EP Category III: issued in 12-month validity periods
  • Apply for renewal at least 3 months before expiry via ePASS
  • At each renewal: submit an updated Succession Plan showing progress against original milestones
  • Provide updated payroll records, SOCSO, EPF contributions
  • Maximum cumulative total: 5 years — after that the role must be held by a Malaysian
  • After 5 years, if you wish to continue employing him: raise salary to RM 10,000+ and apply for Category II (no tenure cap)

Monthly obligations

  • Pay salary on time — bank transfer preferred; keep payslips every month. ESD may request 3–6 months of payslips at renewal.

Current status as of May 2026 — 3 key facts

  • Phase 1 only: Registration is currently limited to refugees held in immigration detention centres. Community-based refugees (like someone living freely in KL) cannot register yet.
  • No community registration date announced: There is no confirmed date for when community refugees can register. Refugeemalaysia.org has explicitly warned that any announcement circulating about "Syrian/Yemeni DPP registration starting on [date]" are scams — not legitimate.
  • Work rights not yet confirmed: Even once registered, DPP may not immediately grant work rights. A February 2026 FMT article states the DPP "may not immediately confer work rights" — that framework is still being developed by the Human Resources Ministry.

If the Syrian worker eventually registers under DPP and work rights are granted for services sector, Maple Home would not need to sponsor an EP. That would eliminate: EP fees, succession plan, and 1:3 internship mandate. Keep monitoring for updates.

How to monitor official updates

What is IMM13?

The IMM13 is a special permit issued under Section 55(1) of the Immigration Act 1959/63, historically granted to Syrian refugees in Malaysia under the 2015 PPSMS programme. It gives the holder legal residency and the right to work.

How it helps Maple Home

If the worker already has an IMM13, Maple Home does not need to sponsor any immigration document at all. He renews the IMM13 himself annually. Maple Home just employs him with a normal contract — same as DPP, essentially no sponsorship burden.

What to do

  • Ask the worker: does he currently hold an IMM13 card? Check the physical document.
  • If yes: confirm the expiry date and renew at the nearest Immigration office before it lapses
  • Renewal fee: approximately RM 90–150/year

The trade-off

To use this route, his official job title must match the approved 3D categories — e.g. Housekeeping Supervisor, Facilities Maintenance Coordinator, or Property Maintenance Technician.
